These General Terms and Conditions of Sale govern orders placed on the Ongly Care website.

These General Terms and Conditions of Sale apply to sales made on the website onglycare.com, to individual and professional customers.
The provisions of the French Consumer Code mentioned in these General Terms and Conditions of Sale apply exclusively when the customer qualifies as a consumer under the applicable regulations.
2. Acceptance of the terms
Any order placed on Ongly Care implies full and complete acceptance of these General Terms and Conditions of Sale.
The applicable General Terms and Conditions of Sale are those in force on the date the customer confirms the order. Ongly Care reserves the right to amend them at any time for future orders.
3. Products
The essential characteristics of the products are presented on their respective product pages: description, dimensions, technical specifications, material, grit, references, accessories, or any other relevant information depending on the product.
Ongly Care strives to present products as accurately as possible. However, photographs, graphical representations, and colors are provided for illustrative purposes and may show slight differences, particularly depending on the settings of the screen used.
These potential display differences do not affect the essential characteristics of the product ordered.
Product offers are valid while stocks last.
4. Prices and VAT
The prices displayed on the website correspond to the price applicable to the customer in the currency indicated for the selected market or country.
VAT not applicable – Article 293 B of the French General Tax Code
As of the date hereof, Ongly Care benefits from the VAT exemption regime. Consequently, no VAT is charged or collected on the orders concerned. As long as this regime applies, purchases made from Ongly Care cannot therefore give rise to VAT recovery or a VAT refund under a tax-free shopping scheme.
If the tax regime applicable to Ongly Care changes, any applicable taxes will be indicated to the customer before their order is definitively confirmed.
Shipping costs and any additional fees applicable to the order are indicated before confirmation.
For certain destinations outside the European Union, customs duties, import taxes, or other fees may be required by local authorities under the regulations of the destination country. The applicable terms are specified in our Shipping Policy .
5. Placing an order
Before confirming the order, the customer can review their cart details, selected products, quantities, total price, and shipping and billing information, and correct any errors.
Final confirmation of the order entails an obligation to pay.
After confirmation, an order confirmation is sent to the customer by email at the address provided during checkout.
The customer is responsible for the accuracy of the information provided, particularly their identity, billing address, shipping address, and contact details.
In the event of an error in an order, the customer is invited to contact Ongly Care as soon as possible at info@onglycare.com However, a modification or cancellation cannot be guaranteed once the order has already been prepared or shipped.
Ongly Care reserves the right to refuse or cancel an order for a legitimate reason, including payment failure or incident, suspected fraud, product unavailability, or an obvious error concerning the price or essential information about the offer.
6. Payment
Payment is due when the order is confirmed, except when a payment method with specific terms is offered to the customer.
The payment methods available are those offered to the customer during checkout. They may vary depending on the country, currency, order amount, or available payment services.
Transactions are processed through the secure payment providers offered on the site. If payment is declined by the banking institution or payment provider, the order may not be validated.
7. Shipping and delivery
Shipping methods, prices, and estimated delivery times are indicated during checkout and detailed in our Shipping Policy .
Ongly Care delivers the order on the date or within the period indicated to the customer at the time of ordering. When no specific period has been indicated, delivery takes place without undue delay and no later than thirty days after the conclusion of the contract, in accordance with the provisions applicable to consumers.
For consumer customers, the risk of loss of or damage to the products is transferred to the customer only when the customer, or a third party designated by them, physically takes possession of the products, except where the customer chooses a carrier not offered by Ongly Care.
In the event of a delivery delay, consumers have the rights provided for by applicable regulations, including the possibility, under the conditions laid down by law, of requesting delivery or terminating the contract.
Ongly Care shall not be held liable for any delay or failure to perform resulting from an event meeting the legal conditions for force majeure. However, this provision does not deprive consumers of the mandatory rights granted to them by applicable regulations.
Upon receipt, customers are advised to check the condition of the package and products and to contact Ongly Care promptly if a product is missing, damaged, or non-compliant.
8. Consumers’ right of withdrawal
In accordance with the Consumer Code, a customer acting as a consumer has a period of 14 days from receipt of the product to exercise the right of withdrawal, without having to provide a reason.
When several products from the same order are delivered separately, the period begins on receipt of the last product concerned.
To exercise the right of withdrawal, the consumer must inform Ongly Care of their decision before the expiry of the period, in particular by email to: info@onglycare.com .
No justification is required. A clear and unambiguous statement expressing the wish to withdraw is sufficient.
After notifying Ongly Care of the withdrawal, the products must be returned no later than 14 days following that notification.
The direct return costs associated with exercising the right of withdrawal are borne by the consumer, unless otherwise indicated by Ongly Care.
The consumer may handle the product to the extent necessary to determine its nature, characteristics, and proper functioning. The consumer may be held liable for any depreciation resulting from handling beyond what is necessary for this verification.
The practical return conditions are also set out in our Return and Refund Policy .
The statutory right of withdrawal provided for in this article applies to consumers. It does not automatically apply to purchases made for professional purposes, except where a specific applicable legal provision provides otherwise.

9. Exceptions to the right of withdrawal
In accordance with applicable regulations, the right of withdrawal may be excluded in certain cases provided for by law.
In particular, where they meet the legal conditions:
- products made to the customer’s specifications or clearly personalized;
- products unsealed after delivery that cannot be returned for reasons of hygiene or health protection;
- other products for which the law expressly excludes the right of withdrawal.
The hygiene-related exception applies only when the product’s characteristics and condition after opening legally justify this exclusion. It may not be applied automatically to all Ongly Care products.
10. Refund after withdrawal
In the event of a valid exercise of the right of withdrawal, Ongly Care will refund the amounts paid for the products concerned, as well as the initial delivery costs, up to the cost of the standard delivery method offered.
Any additional costs resulting from the customer’s choice of a more expensive delivery method than the standard method will not be refunded.
The refund will be issued without undue delay and no later than 14 days from the date on which Ongly Care is informed of the decision to withdraw.
For a sale of goods, Ongly Care may defer the refund until the products have been recovered or until the consumer provides proof that they have been shipped, whichever occurs first.
The refund is made using the same payment method as that used for the initial transaction, unless the customer expressly agrees to another method that does not incur additional fees.
11. Legal Warranties
Consumers benefit from the legal warranty of conformity as well as the legal warranty against hidden defects, under the conditions provided for by the applicable regulations.
🛡️ Legal Warranty of Conformity
The consumer has a period of two years from delivery of the goods to request implementation of the legal warranty of conformity when a lack of conformity appears.
Under the conditions provided for by law, the consumer may request repair or replacement of the product, free of charge. Bringing the product into conformity must take place within a maximum period of thirty days following the request and without major inconvenience to the consumer.
When a product is repaired under the legal warranty of conformity, the remaining warranty period is extended by six months.
In certain situations provided for by law — in particular when repair or replacement is impossible, refused, excessively delayed or fails to resolve the lack of conformity — the consumer may obtain a price reduction or rescind the sale.
However, rescission of the sale may not be requested when the lack of conformity is minor.
🔍 Warranty Against Hidden Defects
The customer also benefits from the warranty against hidden defects provided for in Articles 1641 and following of the Civil Code.
When the conditions of this warranty are met, the buyer may, in particular, choose, in accordance with applicable legal provisions, to return the product and obtain a refund of the price or keep the product and obtain a price reduction. The claim must be brought within two years of discovering the defect.

Any commercial warranties or manufacturer’s warranties indicated on certain product pages are provided in addition to the legal warranties and cannot limit their scope.
12. Product Use and Liability
Products must be used in accordance with their intended purpose, technical specifications and, where applicable, the recommendations or instructions for use provided.
Ongly Care cannot be held responsible for damage resulting from clearly inappropriate use, improper maintenance, modification of the product by the customer, or failure to comply with the usage precautions, subject to applicable mandatory legal provisions.
Nothing in these General Terms and Conditions of Sale shall have the effect of excluding or limiting any liability or warranty that cannot legally be excluded or limited, in particular the statutory warranties benefiting consumers.
13. Intellectual Property
The texts, visuals, photographs, graphic elements, logos, videos, editorial content, and other elements appearing on the website are protected by applicable intellectual property laws.
They are the property of Ongly Care or are used with the authorization of their respective owners.
Any unauthorized reproduction, adaptation, distribution, or use, in whole or in part, is prohibited unless prior written authorization is obtained or otherwise permitted by law.
14. Personal Data Protection
Personal data collected in connection with orders and use of the website are processed in accordance with our Privacy Policy .
15. Order Archiving and Evidence
Orders and electronic communications may be retained by Ongly Care under the conditions and for the periods provided for by applicable regulations.
For contracts concluded electronically with a consumer involving an amount equal to or greater than €120, Ongly Care retains the contract for the legally prescribed period, currently set at 10 years, and guarantees access to it for the consumer who requests it.

16. Applicable Law and Dispute Resolution
These General Terms and Conditions of Sale are governed by French law, subject to any mandatory provisions offering greater protection that may apply to the consumer, particularly when they reside in another country.
In the event of difficulty, the customer is invited to contact Ongly Care beforehand in order to seek an amicable solution: info@onglycare.com .
In the absence of an amicable resolution, the dispute may be brought before the competent courts in accordance with the rules of common law and the applicable consumer-protection rules.
A consumer may, in particular, bring proceedings, in accordance with the applicable rules, before the territorially competent court or the court of the place where they resided at the time the contract was concluded or the harmful event occurred.
